Terms and conditions of Diageo nederland bv for the Promotion "Johnnie walker contest"

General

These terms and conditions apply to the promotion "Johnnie Walker Contest", hereinafter referred to as: "the Promotion". The Promotion is organized by Diageo Nederland BV, having its office at Molenwerf 12, 1041 BG Amsterdam , hereinafter referred to as: "the Organiser". [With regard to the main prize, the Organiser works together with Create VC, established in Ghent, Belgium and having its office at Ottergemsesteenweg Zuid 808 box 163, 9000 Ghent, Belgium hereinafter referred to as "Create BV".Create BV is only responsible for the implementation of the main prize of the Promotion.] The Organiser is the user of these terms and conditions. The terms and conditions apply between the Organiser as user and the natural person participating in the Promotion, hereinafter referred to as: "(the) Participant".

The Promotion is organized to promote: Johnnie Walker Squid Game.

The Organiser is responsible for the Promotion and its implementation. By participating in the Promotion, the Participant declares to have taken note of the conditions, to accept the conditions and to be bound by the conditions.

Upon request, the terms and conditions will also be sent by post or e-mail. Such a request can be sent to hello@welcometocreate.com

The terms and conditions can also be downloaded and stored by the Participant.

The Organiser is entitled to disqualify/to exclude the Participant from (further) participation if he believes that the Participant is not acting in accordance with the terms and conditions.

The Action period

The Promotion runs from 21.10.2024 to 10.11.2024 23:59 CET.

The Promotion

The Promotion means that the Participant can win a prize by winning a game of tic-tac-toe and entering in via www.johnniewalker.com/nl-nl/wedstrijd. No purchase is necessary

If the Participant wishes to be eligible for the main prize, the Participant must

Visit the promotion website www.johnniewalker.com/nl-nl/wedstrijd during the promotional period. The required information from the participant includes first name, last name, street, house number (if applicable, floor/door), postal code, residence in the Netherlands, confirmation that the participant is at least 18 years old, and email address.

Participation

The Promotion can be participated by anyone who:

is 18 years of age or older;

lives in the Netherlands

[is in possession of a valid identity document. For Participants competing for the main prize, it must be a valid proof of identity allowing entry to the Netherlands

Excluded from participation are:

permanent and temporary employees of the Organiser;

permanent and temporary employees of third parties who assist the Organiser in the organisation and implementation of the Promotion;

family members in the first line of the workers referred to in point (a) and (b).

The Organiser is entitled to check the age of the Participant on the basis of his/her identity document. In the event of a check, the Participant will show his/her proof of identity at the first request of the Organiser.

Participation in the Promotion is free of charge.

When participating in the Promotion, the name and address of the Participant will be stored.

The Organiser is entitled to exclude the Participant from further participation in the event of entries that appear to be fraudulent or testify to unlawful influence.

A Participant may participate in the Promotion 1x.

No correspondence can be entered into about the outcome of the Promotion.

Course of the Promotion, designation of the winners/winner

The winner of the main prize of the Promotion will be drawn by a notary after the closing date referred to in Article 2.1 from the Participants who have fulfilled all the conditions for competing for the main prize.

Within 14 working days after the end of the registration period, the Organiser will notify the Participants/Participant who won the prize(s) by e-mail to the e-mail address provided by the Participant.

The prize(s) to be won

The winner of the prize will receive (subject to the provisions of Article 8) as a prize a Johnnie Walker branded Squid Game Track Suit. The prize/trip has an economic value of approximately € 20, (twenty euros) is offered by Diageo Nederland BV. Sizes can be chosen according to available sizes based on the order of the drawing.

There are 9 Small tracks suits to be won, all with the same value. The winners will be drawn from the list of Participants.

There are 10 Medium tracks suits to be won, all with the same value. The winners will be drawn from the list of Participants.

There are 10 Large tracks suits to be won, all with the same value. The winners will be drawn from the list of Participants.

The Promoter is entitled to change/withdraw prize(s) and replace them with a prize of comparable or higher economic value.

Payment of prizes/prize

The prize is/The prizes are personal.

The prize is/The prizes are not transferable and is/are not exchangeable for cash or anything else that represents a particular value.

The prize(s) will always be paid out. This means that if a winner does not receive the prize, another draw will take place in order to be able to designate a new winner.

Publication and promotion

By participating in the Promotion, the Participant gives the Organiser, as well as the promotional partners involved by the Organiser in the Promotion, permission to use his/her name and e-mail address as well as the right to produce and use film material and photos in/for promotional activities in connection with the Promotion.

The Participant will also, at the request of the Organiser, cooperate with any promotional activities insofar as it concerns a reasonable request from the Organiser. The Participant who cooperates in the promotional activities is not entitled to any financial compensation from the Organiser or its promotional partner.

The Participant who wins a prize agrees that the Promoter may use film material and photographs with the winner's portrait for promotional purposes.

Prior to any reproduction and publication of the material with his/her portrait, the Participant will be asked to sign a statement confirming this permission.

If the Participant still indicates that he does not want to cooperate with promotional activities of the Organiser or the reproduction and publication of material with his/her portrait, the Organiser is entitled to have a draw carried out again and to designate a new winner.

Liability

Participation in the Promotion is at the participant's own risk.

Apart from its - inescapable - legal liability, the Organiser is not liable for any direct and/or indirect damage whatsoever suffered by a Participant in connection with or arising from Participation in the Promotion.

The Organiser is not liable for, among other things, damage suffered by the Participant/winner as a result of typing and printing errors on the Organiser's website or in any other medium/communication tool, the use of the prize or the fact that the Participant is not, or not sufficiently insured.

The Promoter cannot be held responsible or liable for failures in the IT systems that result in limited, delayed or loss of entries.

Personal Data/Privacy

The name and reference and/or other personal data that the Organiser obtains in the context of this Promotion will be included in its database and will be treated confidentially and in accordance with the GDPR/Personal Data Protection Act.

Participant guarantees that the information provided by hem/her is correct.

The Organiser will use the data of the Participants for the execution of this Promotion and communication around the Promotion, including the sending of the e-mail confirming participation and contact the prize winners by e-mail and telephone if necessary. Any other e-mails will only be sent if the Participant has given permission for this. A Participant in this Promotion can by e-mail hello@welcometocreate.com request access, deletion and/or correction of his/her data.

The Organiser will not provide personal data of the Participant to third parties without the explicit written consent of the Participant.

Complaints Procedure

Questions, comments, or complaints about the Promotion can be made known by e-mail to Department Marketing/Communication hello@welcometocreate.com. The Organiser will make every effort to deal with any complaints as soon as reasonably possible. If the Participant believes that the complaint has not been adequately dealt with, a written complaint can be submitted to the Gaming Authority, P.O. Box 298, 2501 CG The Hague.

Gaming tax

If gaming tax is to be paid on the prizes, the gaming tax due will be fully borne by the Organiser.

Final provisions

The Organiser is entitled, at its own discretion, but with prior notice, to change the conditions in the interim provided that change is not made to the detriment of the Participants, or to stop or change the Promotion without giving any reason if the circumstances reasonably or force majeure so require, without being liable in any way for compensation to the Participant.

In the event that a provision of these terms and conditions is invalid, or is nullified, the Organiser will adopt a replacement provision that approximates as closely as possible the purpose and scope of the invalid or nullifying provision and that is not invalid or voidable.

Participation in the Promotion implies the unconditional acceptance of these terms and conditions, without any reservation or limitation, as well as of any decision that the Promoter may make in this regard.

If (the Dutch part of) the Promotion should be qualified as a promotional game of chance, this game complies with the Code of Conduct for Promotional Games of Chance.

The Promotion (conditions) are governed by Dutch law.
